In a NYT Editorial today they talk about the Supreme Court voting 7-1 to invalidate the conviction of Timothy Tyrone Foster because every black person had been excused from the jury.
The prosecutors in Mr. Foster’s case kept notes that served as a remarkably explicit road map of how to discriminate in jury selection. For example, they highlighted the names of black prospective jurors on one list with a “B” and, on another list, ranked them against one another, in case “it comes down to having to pick one of the black jurors.
Somehow in Clarence Thomas’ mind this is not about race. Fascinating and disturbing. I’m actually rather pleased that he was the only one dissenting. It gives me some hope that the Court is not a totally partisan shit show like some other branches of government.
